The user agreement
In order to ride an electric scooter, you have to download an app from the electric scooter company. That app requires that you click and agree to a user agreement drafted by the electric scooter company. Some user agreements are quite lengthy. For example, the user agreement for Bird is 58 mobile pages long! Buried within those pages are things like liability waivers, assumption of risk disclaimers and binding arbitration agreements. Some companies even accelerate the deadline that you have to file your claim from the typical two (2) to one (1) year. Other companies put a cap on damages, limiting them to $100.
The laws that apply
Even though you are riding an electric scooter, you are bound to follow the rules of the road or what are called the motor vehicle statutes in the city or state where you are riding the scooter. However, most cities and states require that you ride these electric scooters in bike lanes, not on city roads. Further, you are typically required to use turn signals like you would if you were driving a vehicle without blinkers. This means you would have to take one hand off of the handlebars to make that signal. This is an important point because the user manual for the makers of these scooters says that you should never remove both hands from the scooter. Removing one hand makes it extremely difficult to control the electric scooter.
These scooters are fast – really fast
Electric scooters often go 15 miles per hour or more. While that may not seem fast, that is the top speed of most golf carts and certainly faster than any skateboard could go by human power. People often don’t – or can’t – appreciate the speed of these scooters and can quickly lose control of the scooter. Also, the small wheels on these scooters weren’t designed to travel at that speed and certainly aren’t equipped to negotiate a half-inch curb at that speed.
The most common type of injury
The most common type of injury that we see involving electric scooters is a broken tibula or fibula. This is because people put their foot out to slow or stop these scooters which causes their leg to get caught and ultimately broken by the impact. Malfunctions like faulty brakes or accelerators that get stuck also cause people to try to jump off these scooters which eventually leads to injury.
