In order to ride an electric scooter, you have to download an app from the electric scooter company. That app requires that you click and agree to a user agreement drafted by the electric scooter company. Some user agreements are quite lengthy. For example, the user agreement for Bird is 58 mobile pages long! Buried within those pages are things like liability waivers, assumption of risk disclaimers and binding arbitration agreements. Some companies even accelerate the deadline that you have to file your claim from the typical two (2) to one (1) year. Other companies put a cap on damages, limiting them to $100.
